Frequently asked questions

Which instruments can be used in succession planning?

They include the will, donations with reserved usufruct, the family holding and the choice of marital property regime. They can be combined, according to each family's situation.

Can probate be done at a notary's office?

It can, by public deed, when all interested parties (heirs and the surviving spouse or partner who is entitled to a share) agree and the situation meets the requirements of the law and of the rules of the National Council of Justice. The presence of a lawyer is mandatory. In other cases, probate is judicial.

Informational answers. They do not replace the analysis of a specific case by a lawyer.
